The rule of Kaz Dausty Qazybek at the age of nine.
On one of the calm days of the brown autumn, the village elders gathered around Keldibek bi and sat on the hilltop. A group of five or six travelers, who had come from afar, tethered their horses to the six-winged white yurt of the bi and soon turned back towards the meeting place. They hurriedly dismounted, greeted Keldibek bi, and exchanged pleasantries with the elders sitting in a circle. Among the travelers, a handsome man in his sixties began to speak. – Our ancestor is the Nayman, and we belong to the Syban clan. My name is Qadirbay, – he briefly introduced himself and then shifted to the matter for which they had come from afar, – I don’t have many livestock, just a herd of two stallions. They are tended by two young men year-round. One day, during a snowstorm, I went to check on my horses that were grazing in the summer pasture. I sent the shivering horse herders to the two ends and stayed there myself. That day, a mare gave birth to a foal. What surprised me was that the newborn foal stood up and shook off its afterbirth, then started to run around the horses. After circling back, it nursed from its mother and repeated the same action. I returned home with joy, thinking, “This foal is going to be a champion.” The horse herders had finished eating and were about to mount their horses. I told them what I had seen and strongly advised them to be cautious with the young foal. Unfortunately, one of my horse herders came back at dusk and reported that the foal had disappeared without a trace. If it was eaten by a wolf or stolen, there was no sign of it. I recognized that foal when it became a five-year-old horse. At the feast of a man named Uaq Ögizbay, the kerbesty came in first, and my horse came in second. When I said, “The ker horse is mine, return it,” this man replied, “It’s a foal born from my blue mare. If you don’t believe me, ask the witnesses beside me,” and he wouldn’t let me near. Even if he gave his life as a witness, I wouldn’t believe him; the horse is mine. I have heard you are a just bi; please give your ruling. Keldibek bi thought for a long time and finally said: – I cannot resolve this; it’s a difficult case. At that moment, nine-year-old Qazybek, who was playing with stones, said: – Father, please give me this case; I will resolve it. – How can you resolve a dispute that I cannot? – he scolded his son and looked at the silent travelers, – I said I cannot resolve this. Don’t waste time. If you want to stay, here’s the house! – Father, give it to me; I will resolve it, – the boy asked again. Once Keldibek’s refusal was clear to them, they agreed: – Let him speak. We are satisfied with this boy’s ruling. The boy, who had been given the authority, led the disputing parties to the pasture and brought in the ewes. – From this flock, you two hold two ewes and tie your belts around their necks. Then, go and recognize their lambs from the pen in the village! Qadirbay elder untied a lamb from the pen, carried it in front of him, and as he was about to leave the village, he thought, “This must be the twin lamb of the ewe I tied the belt on,” and turned back to take another one. When he brought the two back to the earlier ewe, the mother and her lambs bleated and reunited. Meanwhile, the lamb brought by the other side did not approach the ewe with the belt and wandered off on its own. Then Qazybek said: – The horse belongs to this man; return it to him. After both sides reached a fair resolution, the gathered people asked for an explanation. Then the young man who had stolen the kerbesty foal said: – The horse indeed belongs to Qadirbay elder. I took it when it was a foal. I was going to my maternal uncle who lives near Ayaköz, and on my way back, I saw a foal with its afterbirth still not completely dried, running around the horses. All the flaws of my racing blue mare are that she would kill her foal as soon as it was born. When I sent the blue foal to the mare that was searching for her dead foal, she started to nurse it. Thus, I took possession of the foal. – Although I have no son, all my wealth is in my herd of two stallions, and not a single racing horse has gone missing, – said Qadirbek elder when it was his turn to speak. – My ker horse always comes in first, and this time the kerbesty came in first. If you look closely, you will see that the ker horse and the kerbesty were born from the same mare, as there is no difference in their appearance. The gathered people were pleased with Qazybek’s ruling and dispersed.
